Level of gTLD notices issued to trademark holders revealed

In its latest bulletin, the Trademark Clearinghouse (TMCH) has revealed that almost 17,500 notifications had been sent to trademark holders to date, while brand owners themselves had submitted 26,802 marks to the TMCH.

'Blue' marks held to be confusingly similar in 'surprising' decision

In <i>MOL Magyar Olaj- és Gázipari Nyrt v OHIM</i>, the General Court has upheld a decision of the Second Board of Appeal finding that there was a likelihood of confusion between the mark MOL BLUE CARD on the one hand, and the word marks BLUE, BLUE BBVA and TARJETA BLUE BBVA on the other. Among other things, the court agreed that the element 'blue' had an independent distinctive role in the mark MOL BLUE CARD.
