Students convicted for selling fake copies of Microsoft software

Two students have been convicted of trademark and copyright infringement by the Stockholm District Court for importing fake copies of Windows 7 and Microsoft Office and selling them through online marketplaces in Sweden and Norway. Among other things, the court held that the students' actions were “in the course of business” and that, therefore, they had an extended obligation to examine the origin and authenticity of the goods.

Canada’s Combating Counterfeit Products Act passes latest hurdle

Canada’s Combating Counterfeit Products Act is inching closer to reality, passing its third reading in Parliament late last week. Brian Isaac, partner at Smart & Biggar Fetherstonhaugh, has welcomed the move, noting: “While some concerns have been raised regarding the provisions of Bill C-8, reform of Canada’s anti-counterfeiting laws is overdue and the anti-counterfeiting community in Canada welcomes the apparent renewed interest in the issue by the government of Canada.”

Decision sets the bar for higher level of damages in counterfeiting cases

The District Court of Stockholm has issued its decision in one of the largest and most significant counterfeiting cases in Sweden in recent times. The case involved fake Canada Goose, Lacoste, Ralph Lauren and Lyle & Scott clothes. The court calculated the damages based on a hypothetical licence fee of 20% of the retail price of the goods, which is significantly higher than in previous case law.
