Foreign brand owners challenging bad-faith applications face uncertainty

Two recent cases involving E Remy Martin & Co and Chanel have demonstrated that, when foreign brand owners seek to defend their rights against bad-faith applications, the outcome is very uncertain. Assuming that the TRAB adopted the same standards in these two cases, it looks like the evidence filed with the authorities to demonstrate the well-known status of the cited marks has made the difference.
