Mattress manufacturer fails to prevent registration of BEDTIME marks in Classes 3 and 5

The Court of Appeals has dismissed an opposition by Sealy, the owner of the mark BEDTIME in Classes 20, 24 and 35, against the registration of various BEDTIME marks in Classes 3 and 5 by Johnson & Johnson, but upheld Johnson’s opposition against Sealy’s application for BEDTIME in Classes 3 and 5. Among other things, the court rejected Sealy’s argument that BEDTIME was a well-known mark.

Validity of plaintiff's trademark registration can be questioned at interlocutory stage

In <I>Lupin Limited v Johnson & Johnson</I>, the Full Bench of the Bombay High Court has held that the court can consider the question of the validity of a registered trademark at the interlocutory stage if the registration is <I>ex facie</I> illegal, fraudulent or shocks the conscience of the court. The decision represents a U-turn in the court’s position in this respect.

Industry-INTERPOL anti-counterfeiting agreement highlights benefits of pooled resources

An agreement between INTERPOL and 29 pharmaceutical companies, announced yesterday, will lead to the establishment of a new €4.5 million programme to combat fake medicines. The deal also demonstrates the advantages of pooling resources to work collaboratively with authorities against shared threats.

So the day many had been waiting for (albeit for longer than originally intended) finally arrived and details of the 1,930 gTLD applications were made publically available. ICANN’s press conference to mark the publication proved a lively affair – with news on the URS and likelihood of changes to the batching process, in addition to the revelation of who has applied for what.
