LOVE TO LOUNGE held to be a valid mark

Lidl recently filed for invalidity of Primark’s LOVE TO LOUNGE mark on the grounds that it was descriptive and had no distinctive character. However, the EU General Court dismissed Lidl's application; it held that the mark required some cognitive or intellectual effort on the part of the relevant public when used in relation with the goods in question and therefore had distinctive character.

Madrid System continues strong growth as Zimbabwe finally moves forward with ratification

The World Intellectual Property Organisation (WIPO) has released its latest filing figures report for international trademark applications. The data reveals a healthy 7.2% growth in 2016, with a significant rise in Chinese applicants using the system. Meanwhile, Zimbabwe this week set in process the ratification of the Madrid Protocol – two years after WIPO announced it joined.

Lidl set to finally get CTM for WESTERN GOLD after General Court issues second decision

The General Court has issued its second decision in <I>riha WeserGold Getränke GmbH & Co KG v OHIM</I>, potentially putting an end to the nine-year-long opposition proceedings involving Lidl’s application for WESTERN GOLD and riha WeserGold’s earlier WESERGOLD marks. Among other things, the court reiterated that WESTERN GOLD and WESERGOLD were not similar.

OHIM held to have infringed the rights of the defence

In <I>Lidl Sitftung & Co KG v OHIM</I>, the General Court has annulled a decision of the Second Board of Appeal of OHIM, stating that the latter’s failure to communicate to applicant Lidl evidence of the renewal of the marks on which the opposition was based infringed the rights of the defence.
