The news comes in the week that ICANN published the first responses to the recent GAC advice on the gTLD programme and L'Oréal became the latest company to withdraw a ‘.brand’ application.

Blomqvist v Rolex continued: Supreme Court issues remarks in counterfeit case

Following its 2012 hearing in <i>Blomqvist v Rolex</i>, the Supreme Court decided to refer preliminary questions to the ECJ. This matter, which involved the import of a single fake Rolex watch bought by a private citizen for his own use from a Chinese internet store, attracted worldwide attention. The court has now issued a document detailing the questions.

Novartis leads list of trademark applicants as counsel look to build long-term value

International trademark applications filed under the Madrid system grew by 4.1% in 2012, with Novartis AG topping the list of applicants. This continues the upward trend reported in 2011, despite the continued economic difficulties in many jurisdictions. The challenge for trademark counsel is ensuring that senior management recognise the long-term enterprise value such work facilitates.

Use of mark in educational competition held to constitute use in the course of trade

The Brussels Court of Appeal has upheld an appeal by Responsible Young Drivers, a Belgian not-for-profit organisation promoting road safety, against a decision of the Brussels Commercial Court in which the latter had found that use of the term 'Responsible Young Drivers' in an educational competition did not constitute use in the course of trade or as a trademark.

Use of registered mark beyond scope of protection held to infringe L'Oréal mark

The Shanghai Minhang District People’s Court has held that use of the mark MYBELIVE, which is registered for cleaning products, infringes L'Oréal's MAYBELLINE mark if it is used for cosmetics. The decision implements the "Judicial Interpretation on Several Issues on the Trial of Cases Concerning the Conflict between Registered Trademarks, Trade Names and Prior Rights", issued by the Supreme People’s Court in 2008.

Court offers valuable guidance on enforcement of marks with a reputation

The Athens Multi-member Court of First Instance has upheld a civil action by Papadopoulos Biscuits and Food Industry, the owner of a 3D mark representing cylindrical-shaped gaufrettes, seeking a permanent injunction against a Greek entity manufacturing cylindrical-shaped gaufrettes. In doing so, the court defined for the first time the concept of ‘taking unfair advantage of the distinctive character or repute’ of an earlier mark.
