Star Wars deal propels Disney to top of the ‘most powerful brands’ list

Walt Disney has supplanted Lego as the world’s most powerful brand, according to the Brand Finance Global 500 2016. Acquisition activity has played a key role, with Marvel and Lucasfilm properties propelling the Walt Disney brand up the brand strength league table.

IPEC finds marks descriptive in dispute between educational charities

In <i>NOCN (Formerly National Open College Network) v Open College Network Credit4Learning</i>, a trademark infringement and passing-off dispute between two educational charities concerning the use of the term 'Open College Network' and its abbreviation 'OCN', the Intellectual Property Enterprise Court has held that neither party could claim trademark rights or goodwill in either term due to their wholly descriptive nature.

Fifth Circuit: 'Voice of America' belongs to US government

In a dispute over the use of the phrase 'Voice of America', the US Court of Appeals for the Fifth Circuit, addressing the issues of laches and the reliability of a consumer survey in a defence to a trademark infringement action under the Lanham Act, has upheld a district court’s finding of reliability of the survey and no laches based on lack of prejudice.
