Organisation: Mexican Institute of Industrial Property

The Mexican Institute of Industrial Property has published in the <i>Federal Official Gazette</i> an agreement establishing guidelines for the filing and receipt of applications for the registration of trademarks, collective marks, trade names, slogans and industrial designs through the institute’s payment and electronic services gateway.

In order to provide legal certainty to trademark applicants, IMPI has published criteria for the interpretation and implementation of the Nice Classification. Among other things, if a good or service is not included in the alphabetical list of goods and services of the Nice Classification or in the descriptions of the class headings, the complementary list of goods and services shall be used.

The decree approving the accession of the United Mexican States to the Madrid Protocol has been published in the <i>Federal Official Gazette</i>. The Mexican Senate had approved the country's accession to the protocol on April 25 2012. Among the arguments in favour of accession were cost and time reduction, and the recognition of international priority rights for Mexican trademarks.

The Mexican Institute of Industrial Property has issued a 'declaration of fame' of a figurative trademark consisting of two bulls charging at each other with a circle in the background, which is owned by Red Bull. This declaration is part of Red Bull's efforts to strengthen its marks, which started in 2010 with the declaration of fame of the RED BULL word mark.

The Second Chamber of the Supreme Court of Justice has considered the legal interest necessary to initiate proceedings to obtain an administrative declaration of invalidity of a registered trademark on the grounds of non-use before the Mexican Institute of Industrial Property.
