EFF highlights “trademark bullying” evasion tactics as debate over new gTLD policing heats up

The Electronic Frontier Foundation (EFF) and Public Knowledge have published a report advising domain name registrants that, in a bid to “minimise exposure to trademark bullying”, they should avoid registering domains in the new gTLD environment. While counsel may object to the ‘bullying’ label being extended to legitimate enforcement efforts, the report could have a positive payback for policing strategies.

The prospect of a voluntary copyright and piracy rights protection mechanism, akin to the Trademark Clearinghouse, has been floated by the recently launched Healthy Domains Initiative. While this will raise questions about content policing responsibilities in some quarters, it is a move that many rights holders will welcome.

MPAA scores piracy win with Donuts partnership, opens door for others

The Motion Picture Association of America (MPAA) and the largest gTLD registry, Donuts, have announced a new collaboration that seeks to combat websites engaged in large-scale piracy. The move will be welcomed by creative content producers and, while focused on copyright infringement, opens the door for further initiatives to combat IP infringement.

MARQUES gives gTLDs green light in debate on safeguards

As ICANN’s public comment period to solicit input on how the GAC advice regarding additional safeguards applicable to broad categories of new gTLD strings should be addressed drew to a close (the reply period is open until June 4), there was a rush of submissions. As a representative of all brand owners, MARQUES has urged a compromise that will allow the online expansion to follow current timelines.
