General Court navigates the basics of trademark law

In <i>NEC Display Solutions Europe GmbH v OHIM</i>, the General Court has upheld a decision of the Second Board of Appeal of OHIM in which the latter had found that there was a likelihood of confusion between NEC Display Solutions Europe GmbH’s mark NAVIKEY and Nokia Corp’s earlier mark NAVI. The court provided a reminder of the basic function of trademarks: that they exist as a guarantee of trade origin.
