Functionally non-protectable: Federal Circuit nixes Apple's trade dress claims against Samsung

In <I>Apple v Samsung</I>, the US Court of Appeals for the Federal Circuit has become the latest court to weigh in on the smartphone war between Apple and Samsung. The Federal Circuit overturned the jury’s verdict that Samsung infringed Apple’s trade dress, finding that each of Apple’s asserted trade dress designs was functional and non-protectable.

Delhi High Court provides much-needed clarity on parallel imports issue

In the latest instalment of the parallel imports saga, the Division Bench of the Delhi High Court has ruled in <i>Samsung Electronics Co Ltd v Kapil Wadhwa</i> that India follows the principle of international exhaustion. The court interpreted Section 30(3) of the Trademarks Act as permitting the sale of imported products without the consent of the registered proprietor.

High Court rules on threats and jurisdiction in declaration for non-infringement

In <i>Samsung Electronics (UK) Ltd v Apple Inc</i>, the High Court of England and Wales has considered several preliminary issues in a case involving Apple Inc’s registered Community design for a tablet computer. Among other things, the court ruled that it had no jurisdiction to hear the claim for a declaration of non-infringement in the United Kingdom.
