Chinese brands on the rise in Brandz top 100

The seventh annual Brandz survey has revealed a strong showing for Chinese brands. Thirteen names from China feature on this year’s list of the 100 most valuable brands in the world, which has seen a rise in the Chinese representation every year since the survey began.

Customs circular: parallel imports are legitimate

In another twist to the ‘parallel imports’ saga, the Central Board of Excise and Customs has issued a circular aiming to dispel the uncertainty resulting from the conflicting views that emerged from the <i>Samsung</i> and <i>Dell</i> cases in relation to the import of genuine goods procured without the consent of the registered trademark owner.

High Court rules on threats and jurisdiction in declaration for non-infringement

In <i>Samsung Electronics (UK) Ltd v Apple Inc</i>, the High Court of England and Wales has considered several preliminary issues in a case involving Apple Inc’s registered Community design for a tablet computer. Among other things, the court ruled that it had no jurisdiction to hear the claim for a declaration of non-infringement in the United Kingdom.

While the speakers offered some compelling case studies, use of the ITC for trademark-related dispute remains low. Is that set to change?

Conflicting views on parallel imports lead to confusion for brand owners and importers

A month after the Delhi High Court’s landmark decision in <i>Samsung</i>, the customs commissioner in Mumbai has released a parallel-imported consignment of DELL-branded laptops. Contrary to the court, the customs commissioner stated that the Trademarks Act recognises the principle of international exhaustion of rights and, therefore, the importation of genuine goods procured by lawful means does not amount to infringement.

While the dispute over the IPAD trademark continues in China, Apple’s brand marches on. In the latest Brand Finance Global 500 rankings, Apple has leapfrogged Google to be named as the world’s most valuable brand, achieving the highest ever valuation calculated by Brand Finance.

Delhi High Court issues landmark judgment on parallel imports

In <i>Samsung Electronics Company Ltd v Kapil Wadhwa</i>, the Delhi High Court has delivered what is probably the most exhaustive and instructive judgment on the issue of parallel imports to date. Among other things, the court held that the Trademarks Act recognises only the principle of national exhaustion, rather than international exhaustion.

The search for meaning – are brands failing to create connections?

While companies navigate the different valuation methods in a bid to ascertain true brand value, new research has focused on a different intangible – meaningfulness. Ikea, Google and Nestlé lead the way, but the study also found that consumers feel only a fifth of brands have a notable positive impact on their sense of wellbeing and quality of life, with marked differences in the regional attachment to brands.

Fight to stop gTLDs will extend beyond the application window

Last week almost 90 business associations and companies joined forces with the Association of National Advertisers to form the Coalition for Responsible Internet Domain Oversight and oppose the rollout of the gTLD programme. While some commentators have argued that the call has come too late, the ANA’s general counsel has told <i>WTR</i> that the fight will continue beyond the application window if necessary.
