Even marks with very low level of distinctiveness may prevail against later marks

In <I>BSH Bosch und Siemens Hausgeräte GmbH v OHIM</I>, the General Court has annulled a decision of the Fourth Board of Appeal of OHIM finding that there was no likelihood of confusion between the marks AQUAPERFECT and WATERPERFECT for Class 7 goods. Among other things, the court held that a finding that a mark has weak distinctive character would not prevent a likelihood of confusion from being found.
