Complainant’s case fails to stick in UDRP decision

In a recent Uniform Domain Name Dispute Resolution Policy decision a three-member panel from the World Intellectual Property Organisation Arbitration and Mediation Centre denied the transfer of a domain name because the complainant failed to demonstrate that it was registered and used in bad faith.

Decision under '.nl' Dispute Resolution Regulations show that UDRP precedents serve as important source of reference

In a recent domain name dispute before WIPO, a German toy manufacturer has obtained the transfer of a ‘.nl’ domain name identically reproducing its trademark under the Dispute Resolution Regulations for ‘.nl’ Domain Names. The decision shows that, whilst many ccTLDs have adopted their own domain name dispute resolution policies, UDRP precedents and principles are an important source of reference.

Panel orders transfer of domain name used for attempted cyber fraud

A WIPO panel has ordered the transfer of a domain name under the UDRP because, although the domain name had never been used for an active website, it had been used to send fraudulent emails in an attempted cyber fraud. The case shows that brand owners should consider defensively registering obvious variations of their brands to keep them from falling into the wrong hands and being used to commit what could be a very serious cybercrime.

AOC challenges Telstra

In <i>Australian Olympic Committee Inc v Telstra Corporation Limited</i>, the Australian Olympic Committee failed in an action against Telstra in respect of certain television advertisements and internet postings relating to broadcasts of the coverage of the Rio Olympics by Channel Seven and the sponsorship by Telstra of those broadcasts and internet rebroadcasts.
