The tensions between IP law and indigenous rights continue

International discussions on how best to safeguard indigenous rights continue in heated fashion. This year the debate included the United Nations’ Permanent Forum on Indigenous Issues calling on WIPO to afford greater recognition of indigenous peoples in its decision-making processes and respect for their right to safeguard, preserve or promote traditional resources as they see fit. Similar tensions are being played out at jurisdiction level, with the latest developments in New Zealand providing an example of the challenges posed by trying to protect indigenous rights in existing IP frameworks.

Today saw the official launch on INTA’s Unreal campaign, which aims to educate teens about the value of trademarks and the negative effects of counterfeiting. It may also help shape the IP professional of tomorrow.

Trademark counsel urged to embrace the reality of gTLDs

While the delayed gTLD reveal date has prevented trademark counsel attending this year’s INTA Annual Meeting from discussing the full list of applications, gTLDs remain a hot topic in DC, with ICANN stating that the TLD application system (TAS) held 2,091 applications when it was taken offline. This morning the conference opened with a call for brand owners to embrace the reality of the expanded online space.

ACTA referred to ECJ in bid to dispel concern (updated)

With the number of countries reviewing their position on the Anti-counterfeiting Trade Agreement rising, the agreement is to be referred to the Court of Justice of the European Union in order to assess whether it is compatible with the European Union’s fundamental rights and freedoms. Rather than resulting from concern, the move is intended to fight back against what one commissioner terms “misinformation” and “rumour”.
