India: High court jurisdiction questions set to reshape IP litigation

The jurisdiction of India’s high courts is in the spotlight, particularly when it comes to handling trademark rectification cases under the Trademarks Act. It is hoped that a more rigorous assessment of jurisdiction will discourage abusive filings.

Hershey's defends its ICE BREAKERS mark

The Intellectual Property Court has upheld a lower court’s decision to cancel the trademark ICEBREAKER, registered by Krasny Oktyabr, which is part of United Confectioners. US chocolate maker The Hershey Company, which produces Ice Breakers mints and gums, had filed an action for the cancellation of the mark on the ground of non-use.

The undiscussed trademark implications of 3D printing

Much has been written about 3D printing in both mainstream media and the IP press, with <i>WTR</i> previously identifying the rise in 3D printing technology as a trend for trademark counsel to monitor. To date, much of the discussion has centred on the reproduction – and potential counterfeiting – of such goods as sneakers, spare parts and firearms. However, the news that confectionary products have been successfully printed illustrates that those in the food and pharmaceutical sectors should be paying close attention to this new technology.

Hershey's takes over REESE'S registration

In <i>The Hershey Company v Darvish Baghal Food Industries Company</i>, the Public Court of Tehran has held that the registration of the trademark REESE’S by an Iranian company had been made in bad faith and constituted an act of unfair competition. Hershey's had sought to register its famous REESE’S mark in Iran, but the Trademarks Office had refused the application based on a prior registration for an identical mark.
